Baby Moves for Professionals - Terms of Use

TERMS OF USE

1. About these Terms

These Terms of Use (“Terms”) govern your purchase of, enrolment in and participation in the Baby Moves for Professionals suite of courses, including Baby Moves for Osteopaths (each a “Course”), provided by Growing Bones Pty Ltd (ABN 88 605 293 721) (“we”, “us”, “our”).

By purchasing or enrolling in a Course, creating an account, or accessing any Course Materials, you agree to be bound by these Terms. If you do not agree to these Terms, do not enrol in or access the Course.

2. Definitions

  • “Course Materials” means all content provided as part of a Course, including pre-recorded modules, videos, workbooks, handouts, templates, resources, slides, and recordings of Live Calls.
  • “Course Start Date” means the date on which the Course (or the cohort in which you are enrolled) formally commences, as notified to you at or after enrolment.
  • “Live Calls” means live implementation calls, Q&A sessions or other scheduled live sessions delivered as part of a Course.
  • “Lifetime Access” has the meaning given in clause 7.
  • “you” means the person who enrols in a Course.

3. Eligibility and professional status

The Course is designed for osteopaths, physiotherapists and other regulated health professionals who work with infants. By enrolling, you warrant that:

  • you hold current registration or licensure as a health practitioner with the relevant regulatory body in the jurisdiction in which you practise (for example, AHPRA in Australia); and
  • you will maintain that registration or licensure for so long as you apply the Course content in clinical practice.

If your registration is suspended, cancelled, or subject to conditions that restrict you from treating infants or children, you must not apply the Course content in clinical practice.

4. Educational purpose: the Course is not a substitute for clinical mentorship

This clause is central to these Terms. Please read it carefully.

The Course is a continuing professional development program. The Course content reflects the presenter’s clinical knowledge, experience and interpretation of the available evidence, prepared with due care and to the best of that clinical knowledge at the time of recording. However, the Course content:

  • is provided for general professional education only;
  • is not, and is not a substitute for, in-person clinical mentorship, supervision or hands-on training;
  • is not medical, diagnostic or treatment advice in respect of any particular patient, and does not create a practitioner-patient or supervisor-supervisee relationship between you and us; and
  • does not take into account the unique clinical presentation of any individual patient.

You remain solely responsible for your own clinical decisions, for practising within your registration, training, competence and scope of practice, and for complying with the laws, codes of conduct and professional standards that apply to you. Where the application of any technique, assessment or approach covered in the Course is new to you or beyond your current competence, you should seek in-person clinical mentorship or supervision before applying it in practice. Completion of the Course does not, of itself, certify competence in any technique and does not confer any specialist qualification or title.

While the information in the Course has been researched and presented with due care, it is for general education only and should not be used as a substitute for the advice of a clinical mentor.

5. Enrolment, fees and payment

The Course fee, inclusions and any payment plan options are as described on the Course sales page at the time of purchase. All prices are in Australian dollars and, unless stated otherwise, [include / exclude] GST.

If you purchase on a payment plan, you agree to pay all instalments when due. Your access to the Course may be suspended if an instalment is overdue, and the full balance remains payable notwithstanding the refund policy in clause 6, except to the extent the Australian Consumer Law provides otherwise.

Enrolment is personal to you. Your login may not be shared with, or used by, any other person, including colleagues within your clinic. Clinic or team licences, if offered, are subject to separate arrangements.

6. Refunds and cooling off

Full refund window. You may request a full refund of the Course fee at any time up to and including 5 days after the Course Start Date (or if you have enrolled on or after the Course Start Date, within 5 days of the date of purchase). Refund requests must be made in writing to babymoves@growingbones.com.au within that window. Approved refunds will be paid to your original payment method.

After the window closes. The Course is not refundable once more than 5 days have passed since the Course Start Date, and refund requests made after that time will not be accepted. We encourage you to review the Course description, curriculum and these Terms carefully before enrolling.

Change of mind. Outside the refund window above, we do not offer refunds, credits or transfers for change of mind, for failure to participate in or complete the Course, or for a change in your circumstances.

Your statutory rights. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this clause limits any remedy available to you under the Australian Consumer Law, including where the Course is not delivered with due care and skill, is not fit for the purpose we told you it would be fit for, or does not match its description.

7. Course access, “Lifetime Access” and recordings

Lifetime Access. Where a Course is described as including “lifetime access”, this means access for the lifetime of that Course, that is, for so long as we continue to offer and maintain the Course, and not for the lifetime of the participant. We intend to maintain each Course for the long term, but we may retire, replace or substantially restructure a Course. If we retire a Course, we will give you reasonable notice (of at least [60] days) and reasonable opportunity to download any downloadable resources before access ends.

Live Call recordings. Recordings of Live Calls are made available for 12 months from the date the recording is published, after which they may be removed without further notice.

Updates. We may update, improve, add to or remove individual Course Materials from time to time, including to keep content current with evidence and professional standards.

Platform. The Course is hosted on a third-party platform. Occasional interruptions, maintenance or platform changes may affect access, and we are not responsible for outages beyond our reasonable control.

8. Intellectual property

All Course Materials, including the frameworks, structures, templates, videos and resources, are owned by or licensed to us and are protected by copyright and other intellectual property laws.

We grant you a personal, non-exclusive, non-transferable, non-sublicensable licence to access and use the Course Materials for your own professional education and your own clinical practice. You must not:

  • share, resell, publish, distribute or make the Course Materials available to any other person, including by sharing your login;
  • use the Course Materials to create, deliver or teach your own course, workshop, mentoring program or similar offering, whether paid or unpaid; or
  • reproduce the Course Materials except for reasonable personal working copies (for example, printing a workbook for your own use).

Patient-facing handouts or resources expressly identified as being for use with clients may be used with your own patients in the ordinary course of your practice, but may not be rebranded, resold or distributed beyond that use.

9. Live Calls, case discussion and community conduct

Live Calls may include discussion of clinical cases and questions submitted by participants. You agree that:

  • any case you present or discuss must be de-identified, and you must not share information that could reasonably identify a patient or their family;
  • any input, feedback or discussion provided during a Live Call is general professional education, not advice on the management of a specific patient, and clause 4 applies to it;
  • you will treat other participants with professional courtesy and keep case discussions shared by other participants confidential; and
  • Live Calls may be recorded, and by participating you consent to being recorded and for the Live Calls to be published as part of the Course Materials and any other educational materials that we might produce from time to time. If you prefer not to appear, you may keep your camera off and submit questions in writing.

We may remove from the Course, without refund, any participant whose conduct is unprofessional, unlawful, or disruptive to other participants, subject to any rights you have under the Australian Consumer Law.

10. Liability

To the maximum extent permitted by law, and subject to the consumer guarantees under the Australian Consumer Law which cannot be excluded:

  • we are not liable for and you release us from any loss, damage, claim, cost or expense arising from your application of the Course content in your clinical practice, including any claim by or on behalf of a patient, which remains your professional responsibility and a matter for your own professional indemnity insurance;
  • we are not liable for indirect or consequential loss, loss of profit, or loss of business opportunity; and
  • our total liability in connection with the Course is limited, at our election, to resupplying the Course or paying the cost of having the Course supplied again, or refunding the Course fee you paid.

You must hold, and maintain for so long as you apply the Course content in practice, professional indemnity insurance appropriate to your profession and registration requirements. You agree to provide us with proof of this insurance within 5 Business Days of our request. 

11. Privacy

We collect and handle your personal information in accordance with our Privacy Policy, available at https://www.growingbones.com.au/baby-moves-terms-of-use/ . By enrolling, you consent to us collecting, using and disclosing your personal information in accordance with that policy, including to deliver the Course, process payments through third-party providers, and send you information about the Course and related programs (from which you can unsubscribe at any time).

12. Changes to these Terms

We may update these Terms from time to time. Changes will not apply retrospectively to a Course you have already purchased, other than changes we are required to make by law or changes that do not materially reduce your rights. The current version will always be available at https://www.growingbones.com.au/baby-moves-terms-of-use/ .

13. Suspension and termination

We may suspend or terminate your access to the Course if you breach these Terms in a material way (including sharing your login, infringing our intellectual property, or breaching clause 9) and, where the breach can be remedied, you fail to remedy it within 14 days of written notice. Termination under this clause does not entitle you to a refund, subject to your rights under the Australian Consumer Law.

Enrolment and access to the Course are strictly personal to the enrolled participant. If you share your login details or otherwise provide access to the Course or any Course Materials to a person who is not enrolled in the Course, we reserve the right to immediately remove you from the Course and terminate your access, without refund, subject to any rights you have under the Australian Consumer Law. [We may also recover from you the fees that would have been payable had each person who accessed the Course through your account been properly enrolled.]

14. General

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria. If any part of these Terms is found to be unenforceable, that part will be severed and the remainder will continue in effect. These Terms, together with the Course sales page and our Privacy Policy, form the entire agreement between you and us in relation to the Course.
